These Terms and Conditions apply between you, the user of this website (including any sub-domains unless expressly excluded by their own terms), and ChronoWin Limited (“ChronoWin”, “we”, “us”, “our”), the owner and operator of this website.

By accessing or using this website and/or entering any Competition, you agree to be bound by these Terms and Conditions. If you do not agree, you must stop using the website immediately.

You must be at least 18 years old to use this website or enter any Competition.

2. The Promoter

The promoter of all Competitions on this website is ChronoWin Limited.

References to the “Promoter” in these Terms and Conditions mean ChronoWin Limited.

3. Nature of the Competitions

3.1 ChronoWin operates prize competitions through this website.

3.2 All Competitions operated by ChronoWin include a free postal entry route in accordance with clause 8 of these Terms and Conditions.

3.3 Entrants may enter a Competition either:

by purchasing an entry through the website; or
by using the free postal entry route described in clause 8.

3.4 Free postal entries and paid entries are treated equally within the draw process. The system of allocating prizes does not differentiate between paid and free entries.

3.5 Competitions may include questions, puzzles or other entry mechanics for entertainment and participation purposes only.

3.6 ChronoWin is not affiliated with, endorsed by, or connected with any third-party manufacturer, brand or trade mark featured in a Competition unless expressly stated otherwise.

4. Eligibility

4.1 Competitions are open only to persons who:

are aged 18 or over at the time of entry; and
are residents of Great Britain (England, Scotland and Wales).

4.2 Employees of ChronoWin, its agents, suppliers, advisers, or anyone professionally connected with the administration of a Competition, together with immediate family and household members of such persons, are not eligible to enter.

4.3 By entering a Competition, you confirm that:

you are legally entitled to do so;
you meet the eligibility requirements in these Terms and Conditions; and
you are able to claim any prize you may win.

4.4 We may require proof of age, identity, address, payment authorisation, or any other information reasonably required to verify eligibility.

4.5 Failure to provide satisfactory verification within a reasonable time may result in disqualification.

4.6 Entries from outside Great Britain (England, Scotland and Wales) are not permitted.

5. Your Account

5.1 You must create an account on the website before entering any Competition. By creating an account, you confirm that:

you are aged 18 or over;
you are resident within Great Britain (England, Scotland or Wales); and
all information provided by you is accurate and complete.

5.2 Only one account per person is permitted.

5.3 If you open or attempt to open multiple accounts, or use different identities, names, email addresses, payment methods or other details to circumvent entry limits or eligibility rules, we may:

close all related accounts;
void some or all entries;
refuse future participation; and
retain any entry fees paid.

5.4 You must provide accurate, complete and current information when creating and using your account.

5.5 You must keep your account details up to date.

5.6 We reserve the right, at our sole discretion and without giving reasons, to:

refuse to open an account;
suspend or close an account;
refuse an entry;
disqualify any entrant; or
void any entry or entries.

6. How to Enter Online

6.1 Each Competition will display clearly on the website:

the opening date and time;
the closing date and time;
the draw date and time;
the price per entry, if applicable;
the number of entries available;
any entry cap per person; and
the prize description.

6.2 To enter online, you must:

log into your account;
select the Competition;
select the number of entries;
complete payment; and
submit your entry before the closing date and time.

6.3 You must enter using your full legal name.

6.4 Entries submitted using initials, false names or inaccurate details may be declared invalid.

6.5 All entries must be submitted in English.

6.6 We will usually send confirmation of successful paid entries by email.

6.7 We are not responsible if confirmation emails are not received due to technical or other reasons beyond our control.

7. Entry Limits and Restrictions

7.1 Some Competitions may include a maximum number of entries per person.

7.2 Where applicable, entry caps will be displayed on the Competition page.

7.3 If you attempt to exceed an entry cap, we may:

block the transaction;
void excess entries;
disqualify excess entries from the draw; and/or
retain any related charges.

7.4 Bulk entries, automated entries, script-generated entries and artificially generated entries are prohibited.

8. Free Postal Entry Route

8.1 All Competitions operated by ChronoWin include a free postal entry route.

8.2 Postal entries are only valid if all of the following conditions are met:

you must first create an account on the website;
your entry must be sent by handwritten postcard;
each postal entry must be sent separately;
where multiple entries are sent in a single envelope or package, they will count as one single entry only;
hand-delivered entries will not be accepted; and
the details on your postcard must exactly match the details on your website account.

8.4 Your postal entry must include:

the Competition name;
your full name;
your postal address;
your email address;
your telephone number; and
confirmation that you accept these Terms and Conditions.

8.5 Incomplete, illegible, damaged or unclear entries will be disqualified.

8.6 Postal entries must be received before the stated closing date and time.

8.7 Proof of posting is not proof of delivery or proof of entry.

8.8 If the maximum number of entries for a Competition has already been reached before your postal entry is processed, your entry will not be included.

8.9 We will only email postal entrants to confirm successful entry into the draw, subject to these Terms and Conditions.

8.10 Unsuccessful postal entries will not receive an email or other communication from us.

8.11 All Competitions shall remain open for a minimum period of five (5) working days to allow postal entrants a fair opportunity to participate.

9. Payments and Promotions

9.1 Entry fees, where applicable, are payable at the price displayed on the website at the time of entry.

9.2 Your entry is not valid until payment has been successfully authorised and processed.

9.3 If a payment fails, is declined, reversed, charged back or found to be unauthorised, the related entry or entries will be void.

9.4 We reserve the right to refuse transactions or payment methods at our discretion.

9.5 Any multi-buy discounts or promotional pricing apply only at the time of purchase.

9.6 Where discounts, promotional offers or multi-entry offers are available for paid entries, postal entrants may also participate in such promotions through the free postal entry route in accordance with clause 8.

10. No Refund Policy

10.1 Except where stated otherwise in these Terms and Conditions, all entries are final and non-refundable.

10.2 No refunds will be given for:

duplicate entries;
disqualified entries;
ineligible entries;
late entries;
failed postal delivery;
account suspension or closure resulting from your breach of these Terms.

10.3 Refunds will only be given where:

we cancel a Competition; or
we are legally required to do so.

11. Competition Periods

11.1 Each Competition will clearly display on the website:

the opening date and time;
the closing date and time;
the draw date and time;
the free postal entry route; and
a hyperlink to clause 8 of these Terms and Conditions.

11.2 Each Competition will run from the opening date and time until the earlier of:

the stated closing date and time; or
the point at which all available entries are allocated.

11.3 All dates and times displayed on the website refer to London, England time.

11.4 We reserve the right in our absolute and sole discretion to suspend, cancel or terminate a Competition in exceptional and unavoidable circumstances beyond our control which make it necessary to do so.

11.5 If a Competition is cancelled or terminated, affected entrants will receive a full refund of the entry fees paid for that Competition.

11.6 Competitions will not be extended merely to sell additional entries.

12. Draw Process

12.1 After a Competition closes, all eligible entries will be entered into the draw.

12.2 The winner will be selected using a verified random number generator.

12.3 Draws will be livestreamed on ChronoWin’s official Instagram account.

12.4 Entry lists may be published prior to the draw.

12.5 The draw will take place as soon as reasonably possible after the closing date and time of the Competition as stated on the website.

12.6 The Promoter’s decision regarding the draw and winner selection is final.

13. Winner Selection and Verification

13.1 We will attempt to contact the winner using the details linked to their account.

13.2 Winners are usually contacted within 48 hours of the draw.

13.3 It is your responsibility to ensure your contact details remain accurate.

13.4 We are not responsible if we cannot contact a winner because incorrect or outdated information has been provided.

13.5 If a winner:

cannot be contacted;
does not respond;
does not accept the prize;
fails verification;
is disqualified; or
otherwise breaches these Terms and Conditions,

we may declare the prize forfeited and we will re-draw the winner from the correct entries received before the closing date and time using the same method as the original draw.

13.6 Winners must respond and complete verification within 7 days of first contact unless we agree otherwise.

13.7 Winners may be required to provide:

proof of age;
proof of identity;
proof of address; and/or
proof of authorised payment method use.

13.8 Acceptable identification may include a valid passport or driving licence.

13.9 If a winner is found to be under 18 or outside Great Britain (England, Scotland and Wales), the entry will be invalidated and a new draw will take place.

14. Prizes

14.1 The prize for each Competition will be described on the website.

14.2 All prize descriptions, specifications and market valuations are provided in good faith but may vary slightly.

14.3 Prizes are non-transferable, non-exchangeable and no cash alternative will be offered.

14.4 We reserve the right to substitute a prize with one of equal or greater value only where exceptional circumstances beyond our reasonable control make this necessary.

14.5 We make no guarantee regarding:

market value;
resale value;
future value; or
suitability for any particular purpose.

14.6 Where applicable, any transferable manufacturer warranty may pass to the winner.

15. Winner Publicity

15.1 We may publish or make available limited winner information to demonstrate that a valid award has taken place.

15.2 This may include the winner’s first name, surname initial, county or region, for example “Vicky S from Dorset”.

15.3 By entering a Competition, you agree that if you win, we may use your first name, surname initial, county or region, likeness, photographs, videos and statements for reasonable promotional purposes connected with the Competition and future Competitions.

15.4 If you object to some or all publicity, you must notify us before the Competition closes.

15.5 Even where an objection is made, we may still provide winner information to regulators, the Advertising Standards Authority, law enforcement or other authorities where legally required.

16. Prize Delivery

16.1 Following successful verification of the winner, we will arrange free delivery of the prize to the address in Great Britain (England, Scotland or Wales) stated on the winner’s account.

16.2 Risk in the prize passes to the winner upon delivery.

16.3 Once the prize has been delivered, we accept no further responsibility for it.

17. Fraud, Abuse and Prohibited Conduct

17.1 We reserve the right to disqualify entrants, void entries, suspend accounts or refuse future participation where we reasonably suspect:

fraud or attempted fraud;
false identity or impersonation;
payment fraud or chargeback abuse;
use of multiple accounts;
automated or script-generated entries;
hacking or interference with the website;
abusive or threatening behaviour; or
conduct contrary to the spirit or intention of the Competition.

17.2 No refund will be due where fraud or abuse is suspected.

17.3 We may share relevant information with payment processors, fraud prevention agencies, law enforcement and regulatory bodies where appropriate.

18. Website Use and Intellectual Property

18.1 All website content including text, images, logos, graphics, video, software and code is owned by or licensed to ChronoWin and protected by intellectual property laws.

18.2 You may access and use the website for personal, non-commercial use only.

18.3 You must not:

copy or distribute website content commercially;
interfere with website security or operation;
upload malicious software; or
attempt unauthorised access to any system or data.

20.2 We may process your data for:

administering Competitions;
fraud prevention;
identity verification;
prize fulfilment;
customer support;
legal compliance; and
marketing where permitted by law.

payment processors;
fraud prevention providers;
delivery providers;
professional advisers;
regulators or authorities where legally required.

20.4 We may use identity verification, fraud prevention, geolocation, age verification and account monitoring measures to ensure compliance with these Terms and Conditions and applicable laws and regulations.

21. Limitation of Liability

21.1 To the maximum extent permitted by law, ChronoWin Limited shall not have any liability to you or any winner in connection with or arising from any Competition howsoever caused, including costs, expenses, damages and any other liabilities, provided that nothing in this clause shall limit our liability for personal injury or death caused by our negligence.

21.2 Our total maximum aggregate liability to each winner shall be limited to the total value of any one prize.

21.3 Our total maximum aggregate liability for non-winners shall be limited to the amount paid to enter the Competition.

21.4 Except for any legal responsibility that we cannot exclude in law, including liability arising under laws relating to the protection of personal information, we are not legally responsible for:

losses that were not foreseeable by you and us when these Terms and Conditions were formed;
losses not caused by any breach on our part;
business losses; or
losses suffered by non-consumers.

22. Social Media

22.1 Competitions may be promoted through Instagram, Facebook and other social media platforms.

22.2 Competitions are not sponsored, endorsed, administered by, or associated with Instagram, Facebook or any other social media platform unless expressly stated otherwise.

22.3 By entering, you agree that those platforms bear no responsibility or liability in relation to any Competition.

23. General

23.1 We may amend these Terms and Conditions from time to time.

23.2 The latest version will always be available on the website.

23.3 Any amendment will take effect upon publication.

23.4 If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23.5 These Terms and Conditions, together with our Privacy Policy and any Competition-specific information displayed on the website, form the entire agreement between you and us.

23.6 No delay or failure by us to enforce any right shall constitute a waiver of that right.

23.7 The Contracts (Rights of Third Parties) Act 1999 shall not apply.

23.8 These Terms and Conditions should be read together with:

our Privacy Policy;
any Competition-specific information displayed on the website;
our Free Postal Entry information page; and
our How It Works page.

In the event of conflict, these Terms and Conditions shall prevail.

24. Governing Law and Jurisdiction

24.1 These Terms and Conditions and all Competitions are governed by the laws of England and Wales.

24.2 The courts of England and Wales shall have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms and Conditions or any Competition.
